As I understand it, it's not strictly *illegal*, per se (at least in the police-come-kicking-on-your-door sense), but they could probably take you to court over it for breach of contract. *Distributing* a modified executable, on the other hand, *would* put you in dark-suits-and-badges territory.
If you want to do things legally, the best thing to do would be to write a compatible engine without any exposure to Westwood code.
