Well, it doesn't actually. Whichever side has the abilities to build a structure will build it. However, I don't know if some side like the Good/Badguy has the priority, or it's who's first to build is first to place, as I haven't tested it with several sides having ConYards extensively. It's still enough to have at least one functional AI opponent that is neither GDI or Nod, with but minor differences.
BTW, I've looked up Vladan Bato's file in the Documents section, but it doesn;t contain any info on triggers, teamtypes or variables in the INI files
